These Terms of Service govern your access to and use of FlatRate Pro powered by GearGenius.AI™. Please read them carefully; using the platform means you agree to these terms and to our Privacy Policy.

1. Acceptance of Terms

By accessing or using FlatRate Pro powered by GearGenius.AI™, you agree to these Terms of Service and to the Privacy Policy. If you are acting on behalf of a school, training program, business, or other organization, you confirm that you have authority to accept on its behalf. If you do not agree, do not use the platform.

2. Eligibility and Account Requirements

  • Users must be at least 13 years old to create an account unless an account is created or authorized by a parent, guardian, or educational institution.
  • Users under 18 need parent, guardian, or school approval before purchasing premium services.
  • Schools, colleges, training institutions, or employers may provision accounts for instructors, students, or trainees they supervise.

3. School, Institutional, or Educator Accounts

  • Institutions may create, manage, or disable student or instructor accounts.
  • Institutions are responsible for obtaining parental or guardian consent when required by law, including FERPA and COPPA.
  • Jess Recruiting LLC acts as a “School Official” under FERPA when contracted by an educational institution.

4. User Responsibilities

  • Provide accurate information during registration.
  • Keep login credentials secure and confidential.
  • Use the platform for lawful educational, training, or professional purposes.
  • Do not upload harmful, offensive, or infringing content.
  • Do not attempt to disrupt, interfere with, or reverse engineer the platform.

5. Prohibited Conduct

  • Sharing account credentials with unauthorized individuals.
  • Accessing another user’s data without permission.
  • Uploading malicious code or attempting to disrupt the service.
  • Using the platform to harass, defame, or harm others.
  • Selling, reselling, or sublicensing the service without written approval.

6. Ownership and Intellectual Property

  • Jess Recruiting LLC owns the software, graphics, trademarks, and platform content.
  • Users retain ownership of their job logs, performance records, and uploads.
  • By submitting content, users grant Jess Recruiting LLC a limited license to store and display the content for service delivery.

7. Payments, Subscriptions, and Refund Policy

  • Optional premium features are processed securely through Stripe. Jess Recruiting LLC does not store full card details.
  • Users under 18 need appropriate approval before making purchases.
  • When a school or institution licenses the platform, students are not charged individual fees.
  • Unauthorized payments made by minors may be canceled and refunded upon written request to support@jessrecruiting.com.
  • Subscription fees are non-refundable unless required by law or approved by Jess Recruiting LLC.

8. Termination of Accounts

Jess Recruiting LLC may suspend or terminate accounts if:

  • The terms or applicable laws are violated.
  • The account is inactive for an extended period.
  • False information or unauthorized payments are submitted.

Users, guardians, or institutions may request account deletion at any time by emailing support@jessrecruiting.com.

9. Data Privacy and Student Records

  • Data collection, use, and storage are governed by the Privacy Policy.
  • When the platform is used by an educational institution, student data may be considered an educational record under FERPA.
  • Jess Recruiting LLC does not sell personal or student data for advertising or marketing.

10. Availability and Service Modifications

  • Jess Recruiting LLC seeks to maintain platform availability but downtime may occur for maintenance or unforeseen events.
  • Features or services may change or be discontinued with appropriate notice when required.

11. Disclaimer of Warranties

The platform is provided “as is” and “as available.” Jess Recruiting LLC does not guarantee uninterrupted or error-free access, fitness for a particular purpose, or preservation of data in all circumstances.

12. Limitation of Liability

To the maximum extent permitted by law, Jess Recruiting LLC is not liable for indirect, incidental, or consequential damages arising from use or inability to use the platform. Total liability will not exceed the amount paid in the twelve months preceding the claim.

13. Governing Law

These Terms are governed by the laws of the United States and the State of Arizona, without regard to conflict-of-law principles.

14. Dispute Resolution

  • Contact support@jessrecruiting.com to attempt informal resolution first.
  • If unresolved, disputes will be handled in state or federal courts located in Arizona.

15. Changes to These Terms

  • Jess Recruiting LLC may update these Terms as needed.
  • The “Last Updated” date at the top of the document reflects revisions.
  • Continuing to use the platform after changes are posted indicates acceptance of the updated terms.
